General Provisions
These Terms & Conditions (hereinafter: Terms) regulate the mutual rights and obligations between:
Travelingo, craft business for transport, services and travel agency
Owner: Rafaela Franić

(hereinafter: Agency)
and the user of travel services (hereinafter: Client).
These Terms are an integral part of every reservation, offer, voucher or contract for travel services. By confirming a reservation or making a payment, the Client confirms that they are familiar with and fully accept these Terms.
2. Services Provided
Blue Travel Split organizes and provides:

daily boat excursions
-
daily land excursions
-
private and tailor-made tours
-
other travel services in accordance with the laws of the Republic of Croatia
The Agency may act as a tour organizer or as an intermediary for certain services.
3. Reservations and Payment
A reservation is considered confirmed upon receipt of payment (deposit or full amount), as agreed with the Client.
Payment can be made in cash, by bank transfer, or by other available payment methods.
If payment is not made within the agreed deadline, the Agency reserves the right to cancel the reservation without prior notice.
4. Prices and Service Content
All prices are expressed in euros (EUR) and apply exclusively to the services specified in the tour program or offer.
Services not explicitly listed (e.g. food, drinks, entrance fees) are not included unless stated otherwise.
5. Changes and Cancellations by the Agency
The Agency reserves the right to change the departure time, duration, or content of an excursion due to weather conditions, safety reasons, technical issues, or force majeure.
In the event of unfavorable or changing weather conditions, rough sea, safety reasons, or other extraordinary circumstances, the boat captain and tour staff have the right to modify the excursion route, change the order of visited locations, or adjust the duration of certain parts of the tour.
Such changes are made solely for the safety of passengers and crew and do not constitute grounds for a refund or compensation.
If an excursion is completely cancelled by the Agency, the Client will be offered an alternative date or a full refund.
6. Cancellation by the Client
All cancellations must be submitted in writing (by email).
The following cancellation policy applies:

cancellation up to 48 hours (2 days) before the start of the service – 50% refund of the paid amount
-
cancellation within 48 hours before the service or no-show – 100% of the paid amount is retained, no refund
7. Client Obligations
The Client must follow the instructions of the tour leader, captain, and Agency staff at all times.
Participation in excursions and tours is at the Client’s own risk.
Children may participate only when accompanied by an adult.
8. Liability of the Agency
The Agency is responsible for the proper execution of the agreed service.
The Agency is not liable for:

weather conditions
-
delays or changes caused by third parties
-
loss or damage to personal belongings
-
accidents resulting from failure to follow staff instructions
In cases of force majeure or extraordinary circumstances, the Agency bears no liability for partial or complete non-performance of the service.
9. Complaints and Claims
Any irregularities or issues must be reported immediately during the excursion or tour, allowing the Agency the opportunity to resolve them on site.
Written complaints may be submitted no later than 8 days after the completion of the service.
Complaints submitted after the 8-day period will not be considered, and the Client loses the right to submit any claims or complaints regarding the service.
The Agency is obliged to respond to a complaint within the legally prescribed timeframe.
10. Personal Data Protection
The Agency processes Clients’ personal data solely for the purpose of service execution, in accordance with applicable data protection regulations (GDPR).
11. Final Provisions
These Terms & Conditions enter into force on the date of publication on the Blue Travel Split website.
All matters not regulated by these Terms shall be governed by the laws of the Republic of Croatia.
In the event of a dispute, the competent court in the Republic of Croatia shall have jurisdiction.

Blue Travel Split
1. Opće odredbe
Ovi Opći uvjeti poslovanja (u daljnjem tekstu: Opći uvjeti) uređuju međusobna prava i obveze između:

i korisnika turističkih usluga (u daljnjem tekstu: Putnik).
Ovi Opći uvjeti sastavni su dio svake rezervacije, ponude, vouchera ili ugovora o pružanju turističkih usluga. Potvrdom rezervacije ili uplatom usluge Putnik potvrđuje da je upoznat s Općim uvjetima i da ih u cijelosti prihvaća.
2. Djelatnost i usluge
Agencija Blue Travel Split organizira i provodi:

brodske jednodnevne izlete
-
kopnene jednodnevne izlete
-
privatne i individualne ture
-
ostale turističke usluge u skladu s važećim propisima Republike Hrvatske
Agencija može nastupati kao organizator ili kao posrednik u pružanju pojedinih usluga.
3. Rezervacije i plaćanje
Rezervacija se smatra potvrđenom nakon zaprimljene uplate (akontacije ili cjelokupnog iznosa), sukladno dogovoru s Putnikom.
Plaćanje je moguće gotovinom, bankovnim prijenosom ili drugim ponuđenim načinima plaćanja.
U slučaju neizvršene uplate u dogovorenom roku, Agencija zadržava pravo otkazati rezervaciju bez dodatne obavijesti.
4. Cijene i sadržaj usluge
Cijene su izražene u eurima (EUR) i odnose se isključivo na usluge navedene u programu izleta ili ponudi.
U cijenu nisu uključene usluge koje nisu izričito navedene (npr. hrana, piće, ulaznice), osim ako nije drugačije naznačeno.
5. Promjene i otkazivanje od strane Agencije
Agencija zadržava pravo izmjene vremena polaska, trajanja ili sadržaja izleta zbog vremenskih uvjeta, sigurnosnih razloga, tehničkih razloga ili više sile.
U slučaju nepovoljnih ili promjenjivih vremenskih uvjeta, lošeg stanja mora, sigurnosnih razloga ili drugih izvanrednih situacija, kapetan broda i osoblje izleta imaju pravo izmijeniti rutu izleta, redoslijed posjeta lokacijama ili trajanje pojedinih dijelova izleta.
Takve promjene provode se isključivo radi sigurnosti Putnika i posade te ne predstavljaju osnovu za povrat sredstava ili naknadu štete.
6. Otkazivanje od strane Putnika
Otkazivanje rezervacije mora biti dostavljeno pisanim putem (e-mailom).
Primjenjuju se sljedeći uvjeti povrata:

otkaz do 48 sati (2 dana) prije početka usluge – povrat 50% uplaćenog iznosa
-
otkaz unutar 48 sati prije početka usluge ili nepojavljivanje – zadržava se 100% uplaćenog iznosa, bez prava na povrat
7. Obveze i odgovornost Putnika
Putnik je dužan poštovati upute voditelja izleta, skipera i osoblja Agencije.
Putnik sudjeluje u izletima i turama na vlastitu odgovornost te je dužan voditi računa o vlastitom zdravlju i sigurnosti.
Djeca mogu sudjelovati u izletima isključivo uz pratnju odrasle osobe.
8. Odgovornost Agencije
Agencija odgovara za uredno izvršenje ugovorene usluge.
Agencija ne odgovara za:

vremenske uvjete
-
kašnjenja ili promjene uzrokovane trećim osobama
-
gubitak ili oštećenje osobnih stvari Putnika
-
nezgode nastale nepoštivanjem uputa osoblja
U slučaju više sile ili izvanrednih okolnosti, Agencija ne snosi odgovornost za nemogućnost potpunog ili djelomičnog izvršenja usluge.
9. Prigovori i reklamacije
Putnik je dužan eventualne nepravilnosti ili nedostatke u pruženoj usluzi prijaviti odmah tijekom trajanja izleta ili ture, kako bi Agencija imala mogućnost iste otkloniti na licu mjesta.
Pisani prigovor može se podnijeti najkasnije u roku od 8 dana od dana završetka usluge.
Prigovori podneseni nakon isteka roka od 8 dana neće se razmatrati, te Putnik nakon proteka navedenog roka gubi pravo na podnošenje reklamacije ili prigovora u vezi s pruženom uslugom.
Agencija je dužna odgovoriti na zaprimljeni prigovor u zakonskom roku.
10. Zaštita osobnih podataka
Agencija obrađuje osobne podatke Putnika isključivo u svrhu realizacije ugovorene usluge, u skladu s važećim propisima o zaštiti osobnih podataka (GDPR).
11. Završne odredbe
Ovi Opći uvjeti stupaju na snagu danom objave na web stranici Blue Travel Split.
Na sve odnose koji nisu regulirani ovim Općim uvjetima primjenjuje se pravo Republike Hrvatske.
U slučaju spora nadležan je sud u Republici Hrvatskoj.
U slučaju potpunog otkazivanja izleta od strane Agencije, Putniku će se ponuditi zamjenski termin ili povrat uplaćenog iznosa u cijelosti.
